First Grand Prize Giveaway – Official Rules MyPetBids

1. ELIGIBILITY: Open only to legal residents of USA who are 18 years of age or older at the time of entry. Void where restricted, taxed or prohibited by law.
2. HOW TO ENTER: To enter, simply visit http://www.Mypetbids.com(“Website”) and complete the registration for the Website. Limit one entry per person and household. Additional entries will be discarded. In case of dispute, entries will be declared made by the authorized account holder of the e-mail address submitted at the time of entry. “Authorized account holder” is defined as the natural person who is assigned to an e-mail address by an Internet Access Provider, on-line service provider, or other organization (e.g., business, educational institution, etc.) that is responsible for assigning e-mail addresses for the domain associated with the submitted e-mail address.
3. VERIFICATION: All entries are subject to verification and are void if not entered in accordance with these Official Rules. Winner’s name and address must exactly match name and address entered on Website in order to be verified. Decisions of the judges on all matters related to the giveaway are final and binding in all matters relating to the promotion. All materials submitted will become the property of the Sponsor and will not be returned or acknowledged. Winning gift cards may not be transferred or sold. Entries on Website must be entered by a person and not through an automated system.
4. DETERMINATION OF WINNERS: The members who have registered by January 31st 2009 on the Website will be eligible to be a Grand Prize winner. The Grand Prize Winner will be selected in a random drawing from among all eligible MyPetBids members who have registered on the Website prior to midnight Jan 31st 2009. Grand Prize drawing will take place on or about Feb14th 2009. Drawing and awarding of prizes will be conducted by a Sponsor whose decisions on all matters relating to this giveaway are final. Winner will be notifed via Email or Phone.
GENERAL RULES: Prize winners may be required to complete an Affidavit of Eligibility and Release/Prize Acceptance form within 14 days of the date notice is sent or such other date set by Sponsor. Failure to respond within the applicable time period will result in forfeiture of prize and Sponsor shall have the option to award the prize to an alternate winner. In the event any prize winner is considered a minor in his/her jurisdiction of residence, the prize will be awarded in the name of the minor’s parent/legal guardian and minor’s parent/legal guardian will be required to complete and return all required documentation. Winner may make no substitution/transfer of prize; prize cannot be exchanged for cash. All federal, state and local income taxes are the sole responsibility of the winner. All federal, state and local laws and regulations apply. Participation in the promotion constitutes permission by participants for Sponsor and its agencies to use winner’s name and/or likeness in perpetuity, in any media now known or hereafter developed, for advertising or publicity purposes without further notice or compensation, unless prohibited by law. By participating in the promotion, participants agree to be bound by the Official Rules and decisions of the judges, which are final. By participating, participants agree to indemnify, defend and hold Sponsor and each of Sponsor’s agents, employees, shareholders, contractors and insurers harmless against any and all claims and liability arising out of participation in this promotion or acceptance or use of any prize and for any claims based on publicity rights, defamation or invasion of privacy and merchandise delivery. Winners assume all liability for any injury/damage caused/claimed to be caused by participation in this promotion or use/redemption of any prize. As a condition of entering the promotion, participants agree that (1) under no circumstances will participant be permitted to obtain awards for, and participant hereby waives all rights to claim punitive, incidental, consequential or any other damages, other than for actual out-of-pocket expense, (2) all causes of action arising out of or connected with this promotion, or any prizes awarded, shall be resolved individually, without resort to any form of class action and shall be resolved exclusively by arbitration under the rules of the American Arbitration Association; and (3) any and all claims, judgments and awards shall be limited to actual out-of-pocket costs incurred, including costs associated with entering this promotion, but in no event attorney’s fees. Sponsor, affiliates, subsidiaries and agencies are not responsible for any typographical or other error in the printing, the offering or in the administration of the promotion. In the event there is a discrepancy or inconsistency between disclosures or other statements contained in any promotional materials and the terms and conditions of the Official Rules, the Official Rules shall prevail, govern and control.
RESTRICTIONS: Sponsor is not responsible for any technical problems or any mechanical failures of the Website. In the event of infection by computer virus, bugs, tampering, unauthorized intervention, fraud, technical failures, or any other failures or causes outside the control of the Sponsor which impair or affect the administration, security, fairness, integrity or proper conduct of this promotion, Sponsor reserves the right, in its sole discretion, to cancel, modify, suspend or terminate the affected promotion.
